Terms of Service

§ 01Websites Ruk-Com Hosting does not accept

• Unlawful websites that attack, defame or undermine the monarchy or religion, and websites that attack, disrupt or defame others.
• Pornographic or obscene websites, or websites tending towards obscenity.
• Gambling websites of any kind.
• Websites or systems related to cryptocurrency mining of any kind (crypto miners).
• Websites providing BitTorrent, trackers, online streaming, pirated software, cracks, hacks or warez; distributing viruses, internet worms or trojans; or using this server to attack other servers — for example mail bombs, hack attacks, spamming, port scanning or port probing — as well as downloads of MP3s, software, video and voice clips or music online, whether lawful or not.
• Websites that send email in bulk, or commercial mass e-mailing.
• Websites that send “spam email” (bulk email that recipients did not consent to receive) or post to newsgroup users where the email uses a non-existent return address or is sent at random, such as [email protected], [email protected], [email protected].
• Chain messages intended to generate mass replies, and repeatedly sending the same message to others.
• Using programs or systems for bulk email sending.
• Sending email that results in large volumes of bounces or affects server operation — for example being flooded from a web board, or using a non-existent return address. If you are unsure an address exists, test it with a free email account first.
• Sending email that violates the rights of others or threatens them.
• Websites involved in system intrusion, virus distribution or any publication that is unlawful or immoral and causes disruption or harm to others.
• Websites running scripts or programs that disturb server operation by consuming abnormal amounts of processing power or memory. If detected, the service is suspended temporarily until you fix it; if the breach continues, we close the website immediately and accept no liability for any resulting damage.
• Websites offering free hosting, free web boards, free image hosting, free file hosting or free email, or charging the general public for such use.
• Websites that infringe the trademarks, copyright or intellectual property of other people or organisations anywhere in the world.
• Websites involving threats, fraud, false information, obscene material or narcotics.
• Websites that bring Ruk-Com into disrepute.
• Websites that redistribute Ruk-Com’s system resources — such as email, databases or web space — to the general public without permission. Resources may be used only for activities related to the hosted website, and interpretation of this clause is at Ruk-Com’s discretion.
• Websites that breach the Computer Crime Act B.E. 2550.
• Any other website Ruk-Com considers inappropriate.
• Ruk-Com reserves the right to terminate the agreement or close a website without prior notice and without any refund if you act contrary to the policies above. Ruk-Com reserves the right to determine whether your actions breach these rules.

§ 02Accuracy of customer information

2. Information you provide to Ruk-Com must be true and accurate. If you submit incorrect or false information, Ruk-Com will not fulfil the request.

§ 03Changing a domain name

3. A registered domain name cannot be renamed. If you want a different name, you must pay to register a new domain.

§ 04Service activation after payment

4. Ruk-Com activates the service within 24 hours on business days after receiving complete proof of payment. If payment is made but details are incomplete — for example a missing order number, domain name or contact number — or if there is no contact within one month, Ruk-Com must cancel that order.

§ 05Refunds within 15 days

5. Ruk-Com is willing to refund the service fee if you are dissatisfied with our server service (excluding domain fees) within 15 days, provided you have not breached these terms. Refunds for dissatisfaction apply within 15 days of service activation. Refund conditions:

• Request the refund within 15 days of the service activation date.
• State the reason for the refund request.
• The refund equals the amount Ruk-Com actually received from you (excluding domain fees).
• Once we receive your refund request, the website is shut down immediately.
• Refunds usually take about 1–2 weeks, depending on the accounting process.

§ 06Bandwidth charges for streaming, VPN and BitTorrent

6. If you use the service for streaming, VPN or BitTorrent, Ruk-Com charges for bandwidth separately from the main service.

§ 07Renewal, suspension and data deletion

7. Ruk-Com sends renewal reminders together with the invoice for hosting and for domains registered with us, 30 days and 15 days before expiry. If payment is not made, we must suspend the service temporarily. For domains that are not renewed and move into Hold status with the registrar, you must pay the unlock fee charged by the domain registrar if you want to continue; we tell you the cost once you ask to unlock it.

• For Cloud Web Hosting, Ruk-Com reserves the right to delete data on your server without prior notice if there is no contact or payment for more than 90 days after expiry.
• For Cloud PaaS, Ruk-Com reserves the right to delete data on your server without prior notice when the account credit is insufficient or the service has been suspended for more than 30 days.

§ 08Ruk-Com’s liability

• Ruk-Com’s liability — Ruk-Com is responsible for direct damage caused by a failure in our service that is our own fault, within the scope, conditions and compensation rates defined in the Service Level Agreement (SLA) and the Shared Responsibility document.
• Where Ruk-Com is not liable — Ruk-Com is not liable for damage arising from: (1) your own acts, omissions or errors, such as deleting your own data, misconfiguration, disclosing passwords or using the service contrary to our guidance; (2) software, scripts, applications or content you install, develop or upload yourself, including vulnerabilities or malware that come with them; (3) your failure to back up your own data as required by these terms; (4) force majeure beyond Ruk-Com’s reasonable control, such as natural disasters, external power outages, large-scale cyber attacks, government orders or failures of external network providers; (5) third-party services you choose to use through our platform.
• Liability cap — in any case, Ruk-Com’s total liability to you for damage occurring in a given service period does not exceed the fees you actually paid for that service in the one month before the incident, unless the law provides otherwise.
• Excluded damages — Ruk-Com is not liable for indirect or consequential damage, lost profit, lost business opportunity or loss of goodwill, unless the damage results from Ruk-Com’s wilful misconduct or gross negligence.
• Legal reservation — the limitations in this clause do not exclude or limit liability that the law says cannot be excluded, including liability arising from Ruk-Com’s wilful misconduct or gross negligence.

§ 09Suspension for investigation

9. If Ruk-Com receives a complaint or request, or detects something suspicious, we reserve the right to cancel or temporarily suspend the service in order to investigate and determine the cause.

§ 10Unauthorised credit card use

10. Ruk-Com may terminate the service immediately and unconditionally if you use a forged or stolen credit card, or use a card without the cardholder’s permission, to purchase services.

§ 11Disclosure to government officers

11. Ruk-Com reserves the right to use or disclose your information when requested by government officers, because we cooperate with the Royal Thai Police in investigating websites containing inappropriate content that disturbs public order. If you find or know of such a site, please report it so action can be taken.

§ 12Copyright in content and design

12. Content and website designs created by Ruk-Com are protected by copyright. You may not copy, reproduce or use them elsewhere without our written permission.

§ 13Contact channel and administrator changes

13. Ruk-Com contacts you through the email address used to place the order on the website. To change the administrator or contact email, send the request from that same email. If you cannot use the original email, Ruk-Com may ask for additional documents such as the company certificate or receipt. Without such evidence, Ruk-Com cannot release confidential information to the requester under any circumstances.

§ 14Scope of software and script support

14. Ruk-Com does not provide software/script development or website building services, so we reserve the right not to answer questions about programming, script usage or website creation — we may instead provide relevant links for you to study. We answer questions related to web hosting and email only. Our core role is to run the hosting and email servers so that they work with all the features listed on our website.

§ 15Virus-infected files on the server

15. Any files you keep on the server — website files, email files, database files and so on — are automatically blocked from access without prior notice if they become infected with a virus.

§ 16Exceeding package resources

16. Ruk-Com reserves the right to suspend the service temporarily if you exceed the quota, traffic or resources of the package you subscribe to. Please contact our sales team to upgrade your package.

§ 17Cancelling or downgrading before term end

17. If you cancel or downgrade the service before the end of the contract term, you are not entitled to a refund of any part of the fee, unless Ruk-Com is the party cancelling the service, in which case we refund a reasonable amount.

§ 18Your backup responsibility

18. You must back up the data files kept on the server. If you request a backup file from Ruk-Com, you must pay the service fee for us to produce that copy.

§ 19Changes to this agreement

19. Ruk-Com reserves the right to change this service agreement at any time without prior notice.

§ 20Consent to disclose personal data

20. You consent to the disclosure of the personal data submitted at registration — such as name, surname, address, email, contact number, company information and contact details — for the following purposes:

• So that Ruk-Com staff can contact and coordinate with you when a problem arises with our services.
• For registering domains with the domain registrar, as confirmation of domain ownership.
• When requested by government officers.
