§ 01Our service

Our service — your domain registration takes effect when all of the following happen:

  1. You accept all the terms and conditions of this registration agreement and the company’s terms of service and supporting documents.
  2. The company accepts your domain registration application, at its sole discretion.
  3. The company receives payment of the registration, renewal and restoration fees as applicable; and
  4. The company submits the domain registration data you provided to the registry administrator for the relevant TLD, and that registry administrator makes your domain registration application effective.

§ 02Multiple domain registrations

Multiple domain registrations — under ICANN policy, the company reserves the right to refuse to register multiple domain registrations.

§ 03Fees

  1. Payment of fees under the domain registration terms. In consideration of the domain registration services the company provides, you agree to pay the company, before the requested domain registration takes effect, all registration fees and other related fees as stated, through the payment method chosen at the time of registration. All fees are non-refundable, in whole or in part, even if your domain registration is suspended, cancelled or transferred before the end of the then-current registration term. It is the domain registrant’s responsibility to keep appropriate records documenting and proving the original domain registration date.
  2. Reservation of the right to change fees. The company reserves the right to change fees, additional fees and renewal fees, or to set new fees, at any time on 30 days’ notice, for any reason, at its sole discretion.
  3. Credit card chargebacks for domain registration. If a credit card company charges the company back (or another payment provider we use takes similar action) for a card used to pay registration or other fees, you accept and acknowledge that the domain registration will be transferred to the company as the entity that paid the registrar for that registration, and we reserve all rights over that domain, including but not limited to the right to make it available for others to purchase. The company also reserves the right to lock your account and your remaining domains until we receive payment of the administrative fee and/or chargeback fee from you. At the company’s sole discretion, we may restore your domain registration, subject to the company receiving the registration fee and any administrative and/or chargeback fees described above.
  4. Credit card chargebacks for non-domain registration services. If a credit card company declines payment (or another payment provider takes similar action) for a card used to pay non-domain registration fees, you agree and acknowledge that the service will not start — or will be cancelled if it was already active — and any data the service holds may be deleted along with your account, while your remaining services are locked until we receive payment of the administrative fee and/or chargeback fee from you. At the company’s sole discretion, we may restore your service, subject to the company receiving the non-domain registration fee and any administrative and/or chargeback fees described above.

§ 04Required domain registration data

  1. Registration data. As part of the domain registration process and under ICANN policy, the registered name holder must submit — and update within seven (7) days of any change — complete and accurate information, including: the domain registrant’s name and postal address; the domain requested; administrative contact details including the name, postal address, email address, telephone number and fax number of the administrative contact for the domain, if any; technical contact details including the name, postal address, email address, telephone number and fax number of the technical contact for the domain, if any; and billing contact details including the name, postal address, email address, telephone number and fax number of the billing contact for the domain, if any (together, the “registration data”).
  2. Additional registration data. Under ICANN policy, the company must also submit and maintain current, complete and accurate additional information about the domain registration, which may include (together, the “additional registration data”): the date the domain registration was first created; the date and time of registration to us and by us for valid registrations; communications (electronic or paper) containing registration, amendment or termination instructions and related correspondence between you and us; account records for your domain registration, including the dates and amounts of all payments and refunds; the IP addresses of the primary and secondary name servers for the domain and their corresponding names; the name, postal address, email address, telephone number and fax number of the technical contact for the domain, if any; the name, postal address, email address, telephone number and fax number of the administrative contact for the domain, if any; the registration expiry date; and information about all other activity between you and us concerning the domain registration and related services.
  3. Use of registration data and additional registration data. You agree and acknowledge that the company will disclose the registration data and additional registration data to ICANN and to other third-party registry administrators such as VeriSign, Inc., Global Names Registry Ltd., Neustar, Inc., Afilias USA, Inc. and Global Domains International, and as applicable law may require or permit. You further acknowledge and accept that ICANN and the registry administrators may set guidelines, limits and/or requirements about the amount and type of information the company may or must disclose to public or private bodies, and how that information is published. You also consent to that disclosure and use, and to the practices, limits and restrictions on disclosing or using the information you provide about any and all domain registrations (including updates), whether during or after your domain registration term. Furthermore, you irrevocably waive any and all claims and causes of action that may arise from the disclosure or use of your registration data and additional registration data.
  4. Data update and accuracy obligations. As a condition of your continued domain registration, you must provide us with updated registration data within seven (7) days of any change. You can review, correct or update your registration data through the company’s domain management service, domain management console or a similar service available on our website. Under ICANN policy, you acknowledge and agree that wilfully providing inaccurate information or failing to update your registration data within seven (7) days of any change is a material breach of this registration agreement, and we may cancel your domain registration at our sole discretion. You further agree that failing to respond within ten (10) days to any company enquiry about the accuracy of the registration data, or failing to contact the company promptly on discovering a deliberate inaccuracy (such as a phone number shown as 000-0000) relating to your domain registration, constitutes a breach of this registration agreement and is sufficient grounds to cancel your domain registration. You also warrant that you have obtained the consent of any third party whose personal data you supplied as registration data.
  5. Data requirements for renewal. When renewing a domain registration, the types of information you must supply may change. If you do not want to provide the newly required information, your domain registration may not be renewed.
  6. Data ownership. You agree and acknowledge that the company owns the database, the compilation, the collective and similar rights, title and worldwide interest in our domain database (the “domain database”), and all data and derivative works created from that domain database, consisting of the registration data and the additional registration data. You agree and acknowledge that the company may use the following data for domain registrations for which we are the registrar: (a) the date the registration was first created; (b) the registration expiry date; (c) the name, postal address, email address, telephone number and fax number of the technical contact, authorised contact, zone contact and billing contact for the domain registration, if any; (d) any notes relating to the registered domain that appear or should appear in WHOIS or a similar database; and (e) any other information the company creates or receives in connection with providing domain registration services, apart from the domain being registered, the Internet Protocol (IP) addresses of the primary and secondary name servers for the domain and their corresponding names. The company has no ownership interest in your specific personal registration data beyond its rights in the domain database. The company agrees to take reasonable precautions to protect your personal registration data from loss, misuse, unauthorised access or disclosure, alteration or destruction.
  7. Registrant verification. You understand and agree that the registrar must verify the registered name holder’s email address within 15 days of registration, transfer or a change to the registered name holder’s contact details. Failure by the domain name holder to verify the contact details within 15 days is a breach of this registration agreement and results in immediate suspension of the domain name and related services. You also understand and agree that the registrar must verify changes to WHOIS contact details within 15 days of the change. Failure by the domain name holder to verify such a change within 15 days is a breach of this registration agreement and results in immediate suspension of the domain name and related services.

§ 05Domain privacy service

  1. If you purchase the domain privacy service (“domain privacy”), you accept that your registration data will be replaced in public WHOIS lookups with information the company provides, as determined at its sole discretion (the “private WHOIS contact details”).
  2. Even though the private WHOIS contact details appear in public WHOIS results, you remain solely responsible for resolving all financial, creditor or other claims arising in connection with legal or other disputes relating to your domain name registration. Using the domain privacy service does not relieve your obligation to provide correct and accurate registration data and to update and correct it under the terms of this registration agreement.
  3. The domain privacy service is not a general mail forwarding service. You agree not to give the private WHOIS contact details to any third party so that they can send communications to you. The company may terminate the domain privacy service immediately and, at its sole option, disclose the registration data if you breach this agreement.
  4. Notwithstanding anything to the contrary, you agree that the company may inspect and forward communications received in connection with your domain name. You authorise the company to receive, sort, open, forward and destroy any and all mail sent to our address at our sole discretion. You specifically acknowledge that the company has no obligation to, but may, forward certified or traceable mail (such as UPS or Federal Express deliveries), legal notices, or US first-class mail. However, the company will not forward “junk” mail or other unsolicited communications (whether sent by fax, mail or telephone), and you further authorise the company to discard all such communications or return them to the sender. You accept that: (i) mail may be forwarded by ordinary mail forwarding or scanned and emailed to the email address in the registration data; (ii) email will be forwarded to the email address in the registration data; and (iii) callers will be directed to use the email address or postal address in the private WHOIS contact details, and we will forward such mail or email under the terms of this section. We will not pass telephone messages to you. You agree to waive any and all claims arising from your failure to receive communications sent directly to your domain name that the company did not forward or refer to you.
  5. If any domain name using the domain privacy service is transferred to another registrar, domain privacy stops automatically and no refund is given for the unused portion of the service.
  6. Failing to renew the domain privacy service while your domain name registration is still active results in domain privacy being suspended, terminated or cancelled, and your registration data being shown in public WHOIS lookups. Renewing domain privacy after the initial purchase is at the standard retail price and can be done by signing in to your account.
  7. The company expressly reserves the right, at its sole discretion and without any liability to you, to suspend or terminate use of the service and/or disclose the registration data in public WHOIS lookups or to any third party at any time without notice to you: to comply with applicable laws, rules, regulations or requirements, or with a subpoena, court order, official government enquiry or law enforcement request; to comply with ICANN’s Uniform Domain-Name Dispute-Resolution Policy; to resolve all third-party claims, whether threatened or actual, arising from your use of the domain privacy service — including but not limited to avoiding disputes over any claim that the registered domain name infringes or violates a third party’s trademark, trade name or other legal rights; where you breach any provision of this registration agreement or any other agreement you have entered into with the company, including but not limited to the terms of service; to comply with the rules, procedures or practices of the registry governing the domain name extension covered by the domain privacy service, and to protect the integrity and stability of the relevant domain name registration; to avoid financial loss or legal liability (civil or criminal) on the part of the company, its parent, subsidiaries, affiliates, shareholders, agents, officers, directors or employees; and to prevent inappropriate activity of concern to the company — including but not limited to where you use domain privacy to hide your involvement in unlawful or morally objectionable activity, including but not limited to activity intended to or that otherwise: (i) appeals to the prurient interest of third parties; (ii) defames, embarrasses, harms, abuses, threatens or harasses a third party; (iii) violates US state or federal law and/or the laws of foreign territories; (iv) involves hate crime, terrorism or child pornography; (v) is tortious, vulgar, obscene, invasive of a third party’s privacy, racially or ethnically objectionable; (vi) impersonates the identity of a third party; (vii) harms minors in any way; or (viii) involves or transmits viruses, trojan horses, access codes, backdoors, worms, time bombs or any other code, routine, mechanism, device or item that damages, impairs, interferes with, intercepts or misappropriates any software, hardware, firmware, network, system, data or personally identifiable information.
  8. Under paragraph 3.7.7.3 of ICANN’s Registrar Accreditation Agreement (“RAA”), you agree that if you license the use of a registered name (as defined in the RAA) to a third party, you remain the registered name holder (as defined in the RAA) and are responsible for providing complete contact details and for supplying and updating accurate technical and administrative contact details sufficient to facilitate the timely resolution of any issue arising in connection with the registered name. A registered name holder who licenses the use of a registered name under this provision accepts liability for harm caused by wrongful use of the registered name, unless the registered name holder discloses the current contact details provided by the licensee and the licensee’s identity within seven (7) days to a party that provides the registered name holder with reasonable evidence of actionable harm.

§ 06Domain parking

  1. After you register, the domain is automatically placed on name servers provided by the company, and internet users who type the domain are taken to a “coming soon” page (together, “parking a domain” or a “parked domain”). There is no charge for placing a domain in this state. You consent to and authorise the company placing a “coming soon” page and related content on the domain you park. You can change the name server settings (or stop parking the domain) once registration is complete. If you want to register name servers using the domain you are currently registering, those names are placed with the company pending name server resolution after the domain registration is complete, using your manager account.
  2. If your parked domain expires, the parking no longer applies. If you can renew the domain name, you can update the domain name server settings back to what they were. After expiry but before renewal, the domain may be taken to an “expired” page (together, “parking a domain” or a “parked domain”). There is no charge for placing a domain in this state. By not renewing the domain, the company may place an “expired” page and related content on the parked domain. You can change the name server settings (or stop parking the domain) once renewal is complete. If you want to register domain name servers using the domain you are currently renewing, those names are placed with the company pending name server resolution after the domain renewal is complete, using your manager account.
  3. The “coming soon” and/or “expired” pages may contain advertising and other content the company selects at its discretion, which may include third-party websites, third-party product and service offers and/or internet search tools. The company reserves the right to retain all revenue earned from such advertising and other content.
  4. DNS wildcard. If you use the company’s DNS management service and do not set DNS name server settings for your domain, the company may insert a wildcard DNS record to resolve your subdomains that cannot resolve themselves. The company may point those subdomains to a web page that may contain advertising and other content the company selects at its discretion, which may include third-party websites, third-party product and service offers and/or internet search tools.

§ 07Registration renewal

  1. Renewal obligation. You are solely responsible for ensuring that any and all domains and add-on services are renewed before they expire. If you want to renew, you can renew your domain at any time before the expiry date. The company is not liable to you or any third party in connection with renewal, including but not limited to any failure or error in renewing a service.
  2. You may be notified, at the company’s sole discretion, when renewal fees fall due. If those fees are not paid within the time stated in the renewal notice or reminder, your registration will be cancelled. Payment must be made by the other methods we specify on the renewal form. If your billing information is incorrect, you are solely responsible for the failure to renew.
  3. Automatic renewal. You agree that if you pay for any service provided here by credit card or another payment service (such as PayPal), you authorise — but do not oblige — the company to charge your credit card or payment service account automatically and renew the relevant service(s) on or before the renewal date, using the credit card or other acceptable payment details you gave the company. Unless you tell the company that you do not want to take part in its automatic renewal process, the company must receive your notice of intent not to renew (opt out) no later than sixteen (16) days before the renewal date. Without such notice from you, the company will renew automatically for a term of one (1) or two (2) years as determined by the relevant registrar, depending on the TLD or ccTLD of your domain name. Any domain that reaches renewal time will be charged to the credit card or payment service account you have on file with the company at the company’s current rates. You are solely responsible for the credit card or other payment details you give the company and must notify the company promptly of any change (such as a change of expiry date or account number). If the credit card or payment service account expires or is invalid, you are solely responsible for the failure to renew and the company is not responsible for your failure.
  4. Expired domain names. You agree that we may place our contact details in the WHOIS output for expired domain names, because failing to renew results in immediate cancellation of the registration and loss of all rights in the domain name. If you choose not to renew your domain name, you agree that we may renew and transfer the domain name to a third party on your behalf at our sole discretion (an “ED transfer”).
  5. New customers through domain auctions or broker partners and/or ED transfers. If you are registering a domain name that was registered with us and had not yet been deleted by the company at the time of your purchase, you acknowledge and agree that your registration term will run for one year from the original expiry date of the domain name immediately before your purchase. Because the registration results from an ED transfer (as defined above), you will not be compensated for being unable to use the domain from the time it expired until the time it becomes usable in your account. Note: you cannot transfer your domain name to another registrar for sixty (60) days from the date of the previous transfer.

§ 08Domain dispute resolution policy

  1. You agree to be bound by the appropriate domain dispute resolution policy (the “dispute policy”) that applies to the domain you choose, including the Uniform Domain-Name Dispute-Resolution Policy. The dispute policies are developed by ICANN and/or the specific registry administrator and are incorporated into this registration agreement by reference. Certain disputes fall under the relevant dispute policy. If such a dispute arises, you agree to comply with the requirements set out in the relevant dispute policy in force at the time a third party disputes your domain registration. You further agree that, in the event of a domain dispute with a third party, you will indemnify and hold the company harmless under the terms and conditions of the relevant dispute policy. The dispute policies may be amended at any time by ICANN or the relevant registry administrator, and your continued use of the domain registered to you after such an amendment constitutes acceptance of the amended dispute policy and this registration agreement. If you do not accept any such change, you may ask for your domain registration to be cancelled or transferred to another domain registrar. For the adjudication of disputes concerning or arising from the use of a second-level domain name (“SLD”), the SLD holder must submit to the jurisdiction of the courts (1) of the SLD holder’s domicile, without prejudice to any other jurisdiction that may apply, and (2) of the registrar’s location. You also accept ICANN’s Uniform Rapid Suspension (“URS”) rules and consent to submit to any proceeding commenced under the URS, if any.
